Whistleblower claim basics

The Illinois Whistleblower Act offers a number of protections to employees who believe they have evidence that fraud or lawbreaking is occurring at their place of employment. Under the Whistleblower Act, employers are barred from:

  • Committing retaliation against an employee who reports information to a government or law enforcement agency when they hold a reasonable belief that a violation of federal or state law has occurred
  • Committing retaliation against an employee who refuses to participate in an activity that would violate federal or state law, or
  • Enacting any policy that prevents employees from disclosing a violation of federal or state law to a government office or to law enforcement

Retaliation can take many forms under the law, including excessive discipline, demotion, denial of a promotion, or termination. Employees who are found to have suffered retaliation for whistleblowing may be entitled to reinstatement, back pay, attorneys’ fees, and, on some occasions, a portion of the recovery made against a company found to defraud the government.

In addition to Illinois’ Whistleblower Act, there are a number of laws that function within specific industries to protect employees from retaliation for reporting illegal acts in those fields and for seeking redress for violations of the law, including:

  • Occupational Safety and Health Act (OSH Act) whistleblower protections
  • Federal False Claims Act (FCA) or Qui Tam suits
  • Securities and Exchange Commission (SEC) whistleblower program
  • Commodity Futures Trading Commission (CFTC) whistleblower program
